AssetGuard terms of service

Last updated

These terms apply to businesses that install the AssetGuard app on a Shopify store.

1. The agreement

These terms are an agreement between Nevarion Technologies Ltd (“we”), registered in England and Wales under company number 16935174, and the business that installs AssetGuard on a Shopify store (“you”). They apply from the moment you install the app.

AssetGuard is for businesses. By installing it you confirm that you are acting for a business and that you are authorised to accept these terms for the store. Your use of Shopify itself is covered by Shopify’s own terms. How we handle data is set out in our privacy policy.

2. What AssetGuard does

AssetGuard scans your store’s products, collections and blog articles for broken links and for missing or broken images, and lists what it finds. For each finding you can use Fix to replace the broken link or image with one you provide.

Each scan covers up to 2,000 products, 500 collections and 50 blogs with up to 250 articles each, and stops after about four minutes. If a scan hits one of these limits, the app tells you that it was partial.

3. Plans and scan limits

AssetGuard has three plans. They differ only in how many full scans you can run:

PlanFull scans
Free2 in any rolling 30 days
Starter3 in any rolling 24 hours
ProNo limit

A scan that stops because it ran out of time doesn’t count towards the limit. Fix is available on every plan, including Free, and isn’t limited. The current limits are always shown in the app. If we lower them, we will tell you before the change applies to you.

4. Subscriptions, trials and cancellation

Paid plans are subscriptions bought, billed and managed through Shopify. The price, the billing period and any free trial are shown on Shopify’s approval screen before you confirm, and Shopify charges them to your store’s Shopify bill. We never see your payment details.

You can move to the Free plan from the app’s pricing page at any time, which cancels your paid subscription. Uninstalling the app also ends the subscription. If you cancel during a free trial, you are not charged for that plan.

If you think you have been charged in error, email info@nevariontechnologies.com. Any refund we agree is made through Shopify.

5. Fix changes your store

Fix writes to your live store. Each time you confirm a fix, you authorise AssetGuard to make that change through Shopify on your behalf. Depending on the finding, the app:

  • adds the replacement image to a product and removes the broken image from it;
  • replaces the broken address inside a product or collection description;
  • sets a collection’s image or a blog article’s featured image;
  • replaces the broken address inside a blog article’s text.

The change takes effect on your store straight away. AssetGuard doesn’t keep a copy of the content it replaces and has no undo. Before you fix anything:

  • check the finding and the replacement address you enter;
  • keep a backup or export of the products, collections and articles concerned if you may want the old version back.

You are responsible for the replacement links and images you provide, including having the right to use them. Some findings, such as a missing image on a single product variant, can’t be fixed by the app; it tells you so and makes no change.

6. Accuracy of results

AssetGuard checks each address by requesting it from our servers. A link can look broken because the other site was slow, briefly unavailable or blocked automated requests, and a working-looking response doesn’t guarantee the content is right. If your storefront is password protected, the app can’t confirm some links and marks them as unverified instead of broken.

We work to make results useful, but we don’t guarantee that a scan finds every problem or that every finding is a real one. Check findings before acting on them.

7. Your responsibilities

  • Use AssetGuard only on stores you own or are authorised to manage.
  • Don’t try to get around plan limits, interfere with the app, or use it to put load on other sites.
  • Don’t copy, resell or reverse engineer the app, except where the law allows.

8. Support

For help with AssetGuard, email info@nevariontechnologies.com. Include your store’s Shopify domain so we can find your account.

9. Ending the agreement

You can stop using AssetGuard at any time by uninstalling it from your Shopify admin.

We may suspend or end your access if you break these terms or if Shopify ends our access to your store. We may also stop offering AssetGuard; if we do, we will give you reasonable notice where we can, and any paid subscription ends with it.

When you uninstall, the app deletes its access details for your store straight away and moves your store to the Free plan. It keeps your store record, scan history and scan results until Shopify asks us to erase your store’s data, which Shopify does about 48 hours after you uninstall; the exact timing is up to Shopify. The app then deletes all of them. If you reinstall before then, your history is still there.

AssetGuard doesn’t store data about your customers, so customer data requests passed on by Shopify have nothing to return or delete. To have your store’s data deleted sooner, email info@nevariontechnologies.com. More detail is in the privacy policy.

10. Intellectual property

AssetGuard and its software, design and name belong to Nevarion Technologies Ltd. While these terms apply, you may use the app for your store. Your store’s content stays yours; we use it only to provide the app. Shopify is a trademark of Shopify Inc.; we are not affiliated with or endorsed by Shopify.

11. Liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

Subject to that:

  • we are not liable for loss of profit, revenue, sales, goodwill or data, or for any indirect or consequential loss;
  • we are not liable for changes made by Fix that you confirmed, as long as the app made the change you asked for;
  • our total liability to you for all claims in any 12-month period is limited to the greater of the fees you paid for AssetGuard in the 12 months before the claim and £100.

12. Changes to these terms

We may update these terms, for example when the app or the law changes. The date at the top shows when they last changed. If a change is significant, we will tell you before it applies. If you don’t agree with a change, you can uninstall the app.

13. Law and courts

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute about them.
